AN ACT expiring funds to the unappropriated surplus balance in the
state fund, general revenue, for the fiscal year ending the
thirtieth day of June, two thousand three, in the amount of
two million dollars from the joint expenses, fund 0175, fiscal
year 1998, organization 2300, activity 642; in the amount of
ten million dollars from the joint expenses, fund 0175, fiscal
year 1999, organization 2300, activity 642; and in the amount
of eight million three hundred seventy-one thousand seven
hundred seventeen dollars from the personal income tax reserve
fund, fund 1313, fiscal year 2003, organization 1300, and
making a supplementary appropriation of public moneys out of
the treasury from the unappropriated surplus balance for the
fiscal year ending the thirtieth day of June, two thousand
three, to the department of health and human resources -
division of human services, fund 0403, fiscal year 2003, organization 0511 and making a supplementary appropriation of
federal funds out of the treasury from the balance of federal
moneys remaining unappropriated for the fiscal year ending the
thirtieth day of June, two thousand three, to the department
of health and human resources - division of human services,
fund 8722, fiscal year 2003, organization 0511, all
supplementing and amending the appropriation for the fiscal
year ending the thirtieth day of June, two thousand three.

WHEREAS, The Legislature finds that the account balances in
the joint expenses, fund 0175, fiscal year 1998, organization 2300,
activity 642; the joint expenses, fund 0175, fiscal year 1999,
organization 2300, activity 642; and the personal income tax
reserve fund, fund 1313, fiscal year 2003, organization 1300,
exceed that which is necessary for the purposes for which the
accounts were established; and

WHEREAS, The governor has established the availability of
federal funds for continuing programs now available for expenditure
during the fiscal year ending the thirtieth day of June, two
thousand three, which are hereby appropriated by the terms of this
supplementary appropriation bill; therefore
Be it enacted by the Legislature of West Virginia:

That the amount of two million dollars from the joint
expenses, fund 0175, fiscal year 1998, organization 2300, activity
642; the amount of ten million dollars from the joint expenses, fund 0175, fiscal year 1999, organization 2300, activity 642; and
the amount of eight million three hundred seventy-one thousand
seven hundred seventeen dollars from the personal income tax
reserve fund, fund 1313, fiscal year 2003, organization 1300, be
decreased by expiring the above amounts to the unappropriated
surplus balance of the state fund, general revenue and that the
total appropriation for the fiscal year two thousand three, to fund
0403, fiscal year 2003, organization 0511, be supplemented and
amended by increasing the total appropriation as follows:
